These terms apply when you use goferworks.com or Gofer Works services. By using them, you agree to these terms. If you don't agree, please don't use them.
Who we are
Gofer Works provides text-message tools for local home-service businesses, based in Greenville, South Carolina. In these terms, "we" and "us" mean Gofer Works, and "you" means anyone who uses our website or services.
Not an emergency service
Gofer Works does not dispatch emergency help. If you smell gas, see fire or sparks, or anyone is in danger, leave the area and call 911 or your utility's emergency line first.
For businesses that use Gofer Works
A business that subscribes to Gofer Works signs a separate client agreement. If that agreement conflicts with these terms, the client agreement controls. Every business that uses Gofer Works agrees to:
- Give us accurate information about the business, its hours, services and phone numbers.
- Send texts only to people who contacted the business or gave consent, and only for the purposes described in our SMS terms.
- Use Gofer Works only for replies to people who called or texted the business, and not for marketing or promotional texts.
- Follow the laws that apply to text messaging, including the Telephone Consumer Protection Act, and carrier rules.
- Honor opt-out requests. Our system stops texts to anyone who replies STOP, and the business may not message them another way to get around that.
Automated replies
Gofer Works uses software, including artificial intelligence, to write and send replies on a business's behalf. Replies identify themselves as automated. Automated replies can contain mistakes, so appointment times, prices and other details are confirmed by the business. The business remains responsible for the work it performs.
Acceptable use
You may not use our website or services to send spam, harass anyone, break the law, impersonate someone else, interfere with our systems, or try to get access you aren't allowed to have.
Estimates on this site
The calculator and examples on this site are estimates for illustration. They are not a promise of results.
Third-party services
Our services rely on phone carriers, a messaging platform, hosting providers and an AI service. We aren't responsible for outages, delays or undelivered messages caused by those providers or by carriers.
Our content
The Gofer Works name, logo, website and software belong to us. You may not copy or reuse them without our written permission.
Disclaimers
Our website and services are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limits on liability
To the extent the law allows, Gofer Works is not liable for indirect, incidental, special or consequential damages, or for lost profits or lost business. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
Indemnity
Businesses that use Gofer Works agree to cover our losses from claims that arise from their messages, their consent practices, their work or their breach of these terms.
Governing law
These terms are governed by the laws of South Carolina. Any dispute will be handled in the state or federal courts serving Greenville County, South Carolina.
Changes
We may update these terms. We'll post the new version here with a new effective date. Using the website or services after that means you accept the update.
